On Friday, a federal judge in Maryland ordered the Department of Justice to provide daily updates on the measures they are taking to ensure Kilmer Abrego Garcia returns from the El Salvador prison, which was detained since being deported last month.
When DOJ’s lawyers said they didn’t know where Abrego Garcia was now, District Court Judge Paula Sinis expressed dissatisfaction with the court hearing and why the Trump administration has not taken steps to learn why he can bring him back to the United States.
The DOJ told Xinis at the 11:30am ET deadline for submitting it early on Friday to hand over the information as “infeasible.”
The filing department noted that her order came hours after the Supreme Court upheld her previous order to promote the return of Abrego Galica, which the US government said was deported due to administrative errors.
However, in a decision Thursday night, the Supreme Court said, “The government must prepare to share what it can do with regard to the measures it has taken and the outlook for further measures.”
The Supreme Court on Thursday upheld Sinis’ original order in the case that directed the Trump administration to “promote and influence returns.”
However, the Supreme Court told Xinis that it is necessary to make it clear that “Effectuate … is to respect the respect paid to the administrative department in acts of diplomacy.”
Within hours, Xinis revised her order in response to the Supreme Court’s decision and directed the administration to “take all available measures to promote Abrego Garcia’s return as soon as possible.”
Xinis at the court hearing Friday said he is scheduled for another hearing in next Wednesday’s case.
Abrego Garcia was detained by Maryland’s immigration and customs enforcement agency on March 12th and was deported three days later.
The Trump administration has admitted that “it is subject to a tax withholding order banning the removal of El Salvador, and therefore removal of El Salvador is illegal.”
However, a Justice Department lawyer also says it has been discovered that Abrego Garcia is a member of the infamous gangster MS-13.
The Maryland resident’s lawyer denied that he belongs to MS-13 and says his three married fathers have lived in the United States for 10 years without being charged with a crime.
